Description of Services ("the services")

Navix offers tours to individuals and groups that involve travel to space. Our space tours may include a variety of activities, such as spacewalking, experiencing zero gravity, and observing celestial bodies. The exact activities included in each tour may vary depending on the tour package you choose. Please refer to the tour package descriptions on our website for more information as to these activities.

Eligibility

To use our tour services, you satisfy the following conditions:

• You must be at least 13 years old and have the legal capacity to enter into contracts.
• If you are under 18 years old, you may use our services only with the involvement and consent of a parent or legal guardian.
• Regardless of age, you must be in excellent physical and mental health, as will be determined by our physicians.
• You must not have been convicted of any crimes within the previous ten years in any jurisdiction.

Booking and Payment

To book one of our tours, you must use our online registration system or contact our customer service team. You must provide accurate and complete information when booking, including your name, personal and contact information, and payment details. Payment must be made in full within a week after registration. We accept payment by only certain methods, as indicated on your registration confirmation email.

Cancellation and Refunds

Listed below are the cases of cancellation and the applicable refunds, other relevant reparations and legal consequences for each specific case:

• Case 1: You registered for the tour, but did not complete the payment within a week.
  In such a case, your booking is considered to be cancelled, and you will be barred from registration for the next 3 months.
• Case 2: You registered for the tour, paid the requisite amount, and wish to gain a refund.
  In such a case, you will have to reach out to our customer support team. As long as the ticket is raised within 24 hours, you will recieve a full refund. If the ticket is raised after 24 hours of payment, you will be refunded a specific portion of your payment, as given below:
  • For the Around the World™ Tour, you will be refunded 50% of your payment.
  • For the Pinnacle™ Tour, you will be refunded 65% of your payment.
  • For the ISS™ Tour, you will be refunded 80% of your payment.
• Case 3: You registered for the tour, paid the requisite amount, and wish to gain a refund because of uncontrollable external circumstances*.
  In such a case, you will have to reach out to our customer support team and provide them with proper documentation. After review and if you are found to be applicable, you will be asked to choose between a tour date shift into the future based on avaibility and being refunded a specific portion of your payment in a one-time payment, as given below:
  • For the Around the World™ Tour, you will be refunded 75% of your payment.
  • For the Pinnacle™ Tour, you will be refunded 90% of your payment.
  • For the ISS™ Tour, you will be refunded 90% of your payment.
• Case 4: You registered and paid for the tour, but failed to satisfy prerequisite conditions.
  In such a case, you will be refunded 25% of your tour payment and be barred from registration for the next 12 months.
• Case 5: You registered and paid for the tour, but did not participate in the tour.
  Unless you could not attend the tour because of uncontrollable external circumstances*, you will not be refunded any portion of your payment.
• Case 6: You registered and paid for the tour, but are found ineligible for participation.
  You will be given a full refund and be barred from registration for the next 3 years.

Changes to Services

We reserve the right to modify, suspend, or discontinue our services, in any form or part, at any time and without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the services.

Limitation of Liability

Our liability to you for any damages arising out of or related to this agreement or the services shall be limited to the amount you paid for the services. We will not be liable for any indirect, special, incidental, consequential, or punitive damages, whether based on contract, tort (including negligence), or any other legal theory, even if you have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold us and our affiliates, officers, directors, employees, agents, and licensors harmless from any claim, demand, liability, or expense, including reasonable attorneys' fees, arising out of or related to your use of the services, your violation of this agreement, or your violation of any rights of another human and entity. You will accept full responsibility for the same in a court of law.

Intellectual Property

Our website and our service, including all content and intellectual property rights, are owned by Navix or our licensors. You may not use our website or the services for any commercial purpose without our express written consent.

Governing Law and Dispute Resolution

This agreement shall be governed by and construed in accordance with the laws of the United States and the State of Texas. Any dispute arising out of or related to this agreement or the services shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
